Interim and Final Management Orders
What are Interim Management Orders and Final Management Orders?
Interim and Final Management Orders are intended to help the local authority deal with the very worst cases of property management which it comes across when HMO and selective licensing is introduced. An Interim Management Order lasts for a maximum of 12 months and, if the property is still not in a suitable state for licensing at the end of that period, will be followed by a Final Management Order. A Final Management Order lasts for 5 years and may be followed by a further Final Management Order if necessary.
The effect of both orders is to allow the local authority to take over the entire management of the property. Its first duty on doing so will be to take any necessary immediate steps to secure the health and safety and welfare of the occupants of the property or of occupants of nearby premises. It should also enable them to take steps towards ensuring the proper management of the property so that it can be licensed as an HMO or under the selective licensing regime.
