Taxation Investigation Insurance

Free investigation cover, should you need it

HM Revenue & Customs (HMRC) routinely check a proportion of tax returns to make sure they are correct. They may also decide to conduct an extensive examination of all areas of your tax affairs including an in-depth review of your tax return records. All these enquiries take time and money to sort out. Tax Investigation Insurance is designed to take away burdens facing you should you be subject to an investigation. The policy indemnifies you for professional costs whilst you are being represented. How much does it cost?

Insurance cover can cost between £150 and £300, but for Basic+ and Full members it’s included as a part of NLA membership. Terms and Conditions apply.

Qualifying Criteria

All current fully paid up Basic+ and Full members of the National Landlords Association receive the benefit of this valuable protection free of charge, provided they meet the following eligibility criteria:-

Membership of the National Landlords Association must be in force and fully paid up at the time that the investigation is first notified.

The annual rental income of the member must not exceed £500,000.

Only persons, companies, firms, partnerships or organisations specifically named as a member of the NLA at the time of an insured incident are entitled to the protection offered by this insurance policy.

The member must have no outstanding investigations pending and no more than one investigation claim in the past three years or exceeding £3,000 in total.

All members must be domiciled in the UK or Northern Ireland.

The policy will only cover business affairs relating to property portfolios for which the member acts as a landlord or agent.

If you do not qualify for this benefit you may still be able to obtain discounted Tax Investigation Insurance from our insurance providers as a result of your NLA membership. These notes are intended to provide you with information when looking to make a claim under this group Tax Protection Insurance policy. Please read the How to make a claim document in conjunction with the Summary of cover [78KB pdf] and Policy wording [142 KB].

It should be stressed that the assistance under the Policy is only available to current and fully paid up Basic+ and Full Members of the National Landlords Association. When notifying the underwriters of a potential claim you will need to have your NLA membership number to hand.

Who can make a claim under the policy?

This Policy is available for assistance to current and fully paid up Basic+ and Full Members of the National Landlords Association at the time of the insured incident who receive or manage an annual rental income of less than £500,000.

Full Family Membership: The Policy will cover up to three named individuals for property related tax/Inland Revenue and VAT issues (should they be registered for VAT) provided the individuals are all named as Full NLA Members at the time of the insured incident.

Full Business Members: The Policy will cover up to five named individuals and the Business for property related tax claims and VAT disputes, provided they can establish that they own only a small portfolio of property and the individuals and business are named as Full NLA members at the time of the insurance incident. The Policy is not designed to offer assistance to large corporate property owners or managing agents as the tax affairs of these organisations are likely to be extremely complicated and diverse.

The NLA taxation helpline

This telephone-helpline* has been set up to assist members in any questions or queries they have in connection with taxation, VAT, PAYE and NIC issues. The helpline is not dependent on whether you have a claim or incident to report – it can be used any time for general advice. You will need to quote 'NLA Tax Protection' when you contact this helpline and you may be asked to provide the policy number of the scheme and your NLA member number.

The telephone number is 0844 770 1060 and the helpline operates between 8.30am to 5.30pm Monday to Friday excluding Bank Holidays. *Calls to 0844 numbers may cost between 1p and 12p per minute.

Please note that telephone calls are generally recorded in case a dispute over the advice given by the consultant arises or the discussion results in a formal claim. How to make a claim

On you first being made aware of a possible claim under the policy you should firstly contact Arc Legal Assistance’s (the insurance providers) tax consultants by using the NLA Taxation Helpline on 0844 770 1060*. You will then have the opportunity of discussing the potential problem with a taxation consultant.

Any advice that you are given over the phone by the consultant should be followed exactly and to the time scales advised to you. Failure to do this may render any future claim invalid as you may prejudice the insurers’ position. Please note that telephone calls are generally recorded in case a dispute over the advice given by the consultant arises.

Between you and the consultant, a decision will be made as to whether a claim can be made under the Policy. If it is decided that a claim should proceed, you will be transferred to Arc’s taxation consultant who will deal with all aspects of the claim from thereon. Information you have provided to the Taxation Helpline, including transcripts of all telephone calls you have made to the Taxation Helpline on the incident will be supplied to the Claims Team. This ensures continuity of advice and guidance to you from Arc’s taxation consultants. You will need to supply, at this stage, your NLA membership number. Arc Legal Assistance will check this number with either the National Landlords’ Association or Hamilton Fraser Insurance to ensure that you are a fully paid up member of the association. Once the membership information has been accepted by Arc you will be sent a claim form to complete and return to Arc as soon as possible. Again, please follow all advice provided by the claims team exactly as requested and to the time scales advised by them.
